1. Acceptance of Terms

By downloading, installing, or using the HolyCalm application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you (“User,” “you”) and Bruno Silva (“Developer,” “we,” “us,” “our”), the creator and operator of HolyCalm.

2. Description of Service

HolyCalm is an iOS application that provides pre-recorded Christian meditation, prayer, and sleep audio content. The App is designed to support your spiritual wellness journey through guided meditations, Scripture-based reflections, bedtime prayers, and calming audio experiences rooted in the Christian faith.

All content within the App is pre-made and curated by the Developer. The App does not support user-generated content.

3. Subscription Terms

HolyCalm offers premium content through the following subscription plans:

Annual Plan: $19.99 per year, which includes a 7-day free trial for new subscribers.
Monthly Plan: $2.99 per month.

By subscribing, you agree to the following:

Payment is charged to your Apple ID account upon confirmation of purchase (or at the end of the free trial period, if applicable).
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same rate.
You may manage or cancel your subscription at any time through your Apple ID Settings or the App Store.
Any unused portion of a free trial period will be forfeited when you purchase a subscription.
Refunds are handled exclusively by Apple in accordance with Apple’s refund policies. We do not process refunds directly.

Prices are in US Dollars and may vary by region due to currency conversion. We reserve the right to change subscription pricing with reasonable notice.

4. User Content

HolyCalm does not allow users to upload, submit, or share any content within the App. All audio content, written scripts, and visual materials are created, owned, and managed exclusively by the Developer.

5. Intellectual Property

All content available through HolyCalm — including but not limited to audio recordings, meditation scripts, music, sound design, artwork, logos, and the overall App design — is the exclusive property of Bruno Silva or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App and its content for your personal, non-commercial use only. You may not:

Copy, reproduce, distribute, or publicly display any content from the App.
Modify, create derivative works from, or reverse-engineer the App.
Record, download, or extract audio content from the App by any means.
Use the App or its content for any commercial purpose without prior written consent.

6. Health & Wellness Disclaimer

HolyCalm is designed to support your spiritual wellness and personal devotional life. The content provided in this App is not a substitute for professional medical advice, diagnosis, treatment, or psychological counseling.

If you are experiencing a medical or mental health emergency, please contact your local emergency services or a qualified healthcare professional immediately. The Developer makes no claims regarding the therapeutic or medical efficacy of the content.

7. Limitation of Liability

To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the App.

The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

In no event shall the Developer’s total liability to you exceed the amount you have paid for the App in the twelve (12) months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or engage in conduct that we determine to be harmful to the App, its content, or other users.

Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination — including Intellectual Property, Limitation of Liability, and Governing Law — shall continue to apply.

9. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or App features. When we make material changes, we will update the “Last updated” date at the top of this page.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ireland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
